====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 23-10-2024 Ms. Shilpa Kumari, learned Counsel for the Petitioners and Mr. Nitya Nand Tiwary, learned APP for the State.

2. The petitioners apprehend their arrest in connection with Lalganj P.S. Case No. 108 of 2024 dated 02.05.2024 registered for the offences punishable under Sections 341, 323, 302/34 of the Indian Penal Code.

3. The main submissions advanced by learned counsel appearing for the petitioners are that as per allegation, the informant's son was assaulted on 01st May, 2024 and thereafter, he was treated at Referral Hospital, Lalganj and Sadar Hospital, Hajipur from where the deceased returned home after getting treatment and on 02.05.2024, he died which shows that the deceased had not sustained any serious injuries. It is further submitted that both the petitioners are ladies, there is no specific allegation against them and they are simply alleged to have participated in the alleged occurrence and assaulted the

4. Learned APP for the State has opposed the prayer for bail of the petitioners.

Considering the facts and circumstances of this case as well as above submissions and mainly the nature of allegation appearing against the petitioners and mainly coupled with these facts that both the petitioners are ladies and six persons including the petitioners are named in the F.I.R., but the petitioners are not alleged to have assaulted the deceased by fatal means, in my opinion, it is a fit case for anticipatory bail to the petitioners. Accordingly, let the petitioners named-above, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Lalganj P.S. Case No. 108 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shailendra Singh, J) Neha/- U T
