The petitioner seeks bail in Kishanpur P.S. Case No.204 of 2016 registered under Section 414 I.P.C. and under Section 25(1-B)a, 26, 35 of the Arms Act.

The prayer for bail of the petitioner was earlier rejected vide order dated 20.06.2017 passed in Cr. Misc. No.11973 of 2017 with a direction to the trial court to expedite the trial and conclude the same within six months but the trial has not yet been concluded. About nine months has elapsed. It appears that petitioner is in jail since 03.10.2016 for recovery of arms. His prayer for bail was earlier rejected only because the petitioner was having criminal antecedent.

No.9468 of 2018 (2) dt.21-03-2018 Now, since the petitioner has already remained in jail for about 1 1⁄2 years, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Supaul in connection with Kishanpur P.S.
