2. The present writ application has been filed for issuance of direction upon the respondents by an order to investigate properly. In this case petitioner was beaten by Chandra Shekhar Singh and Pooja Devi he lodge First Information Report No.151 of 2022 and he was taken to
Patna High Court CR. WJC No.2056 of 2024(2) dt.30-06-2025 2/2 Primary Health Centre, Gayaghat by Police for treatment. Thereafter, Primary Health Centre, Gayaghat sent him immediately to S.K.M.C.H., Muzaffarpur. The doctor referred him to Patna Medical College Hospital, Patna. Thereafter, the petitioner was admitted in Maan Janki Hospital, Bairiya, Muzaffarpur. Thereafter, from the advice of doctor, X-Ray, C.T. Scan was done and doctor found serious fracture at face and scalp and also haemorrhage in brain. The petitioner was admitted there for about ten days but Gayaghat Police, submitted injury report finding injuries as simple in nature. The petitioner filed an application before the Chief Medical Officer, thereafter, the court of Special Judge, Vigilance, had not considered the case of the petitioner and passed the order dated 12.03.2024 in vide Complaint Case No.18/2023.
3. This application is permitted to be withdrawn with liberty to the petitioner to file a quashing application challenging the order of the learned Special Judge by which his application has been dismissed.
