JUSTICE ARUN KUMAR ORAL ORDER 16-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 1.2.2018, seeks bail in Jhajha PS Case No. 162 of 2017 registered under Sections 399, 402 of the IPC and Sections 25(1-b)a, 26 and 35 of the Arms Act. The allegation in brief is that some miscreants had assembled for making plan for committing dacoity, the police reached there and apprehended one person who disclosed names of his other associates including the petitioner who succeeded in fleeing away.
Learned Counsel for the petitioner submits that except disclosure of name of the petitioner by the apprehended accused Mukesh Das @ Shri Ram Das there is no other material against him and the police during investigation has not recovered any incriminating material from the petitioner more over the petitioner is in custody since 1.2.2018.
Having considered the said facts and circumstances, the petitioner, namely, Rajesh Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two
Patna High Court Cr.Misc. No.22356 of 2018 (2) dt.16-04-2018 sureties of the like amount each to the satisfaction of CJM Jamui in connection with Jhajha PS Case No. 162 of 2017. The petitioner is directed to appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
