The petitioners apprehend their arrest in connection with Siswan (Chainpur O.P.) P.S. Case No. 100 of 2019, registered under Sections 363 and 366/34 of the Indian Penal Code.

The accusation is of kidnapping of Priyanka Soni, wife of brother of informant, Santosh Prasad, and her minor son, aged about 4 years, by four persons named in the F.I.R. including the petitioners for the purpose to perform the marriage.

Patna High Court CR. MISC. No.61733 of 2019(2) dt.14-10-2019 2/2 Learned counsel for the petitioners submits that petitioners along with Shotraghan Soni, who are co-villagers of informant, have falsely been implicated in this case mere on suspicion. Moreover, the statement of victim, wife of brother of informant, was recorded under Section 164 Cr.P.C., in which, she has clearly stated that due to torture by her Sasural people, she left the house along with her minor child and went at the house of her sister and also she denied about her kidnapping by anyone, which would appear from annexure 2 to the petition.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Siwan, in connection with Siswan (Chainpur O.P.) P.S. Case No. 100 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
