The petitioner seeks bail in a case registered for offences under Section 30(a)(g)/32(2)/37(b),41(1)/56(c) of the Bihar Prohibition and Excise Act,2016.

It is contended that, as per allegation, 60 liters of country-made liquor was recovered from the EON Car. The petitioner was arrested in a drunken state while he was passing through the road. It is further contended that two co-accused persons had been granted bail by a Co-ordinate Bench of this Court vide order dated 16.03.2018 passed in Cr. Misc. No. 15400 of 2018. It is also contended that the charge-sheet/ prosecution report has been submitted in this case. Petitioner claims that he is having clean antecedent and is in custody since

Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Patna in connection with Kotwali P.S. Case No. 705/2017, Spl. Case No. 9221 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
