The petitioners are in custody in connection with Dinara P.S. Case No.121 of 2017, a case under Section 366A/34 of the Indian Penal Code and Section 8 of the POCSO Act. According to F.I.R. co-accused Bipin Choudhary is alleged to have enticed away the daughter of the informant to go with him. When the petitioners were contacted, they informed that the victim would return within five days. However, the victim did not return. Hence, the informant suspected that for the purpose of marriage with Bipin the victim had been kidnapped. The statement of the victim would reveal that though she has alleged kidnapping by all the accused persons including

Patna High Court Cr.Misc. No.5247 of 2018 (2) dt.31-01-2018 P2/ the petitioners. However, the perusal of entire statement would reveal that the matter is of love-affairs between the victim girl and Bipin.

Considering the aforesaid fact, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
