JUSTICE HARISH KUMAR ORAL ORDER 15-03-2023 Mr. Ravi Parmar, learned counsel for the petitioner submitted that earlier notice was issued to the respondent no. 2 and the time was allowed to file requisites within one week. However, some delay has occurred in filing the requisites, which, in the humble submission of learned counsel, was not an intentional and wilful rather the same has occurred on account of some unavoidable circumstances as has been mentioned in the modification application. Thus, he seeks unqualified apology for the delay in filing of the requisites.

Learned counsel for the State is present.

In view of the submissions made on behalf of the petitioner, the order dated 21.07.2022 passed in Cr. Appeal (SJ) No. 1355 of 2022 is modified and the requisites filed on behalf

Patna High Court CR. MISC. No.14737 of 2023(2) dt.15-03-2023 2/2 of the petitioner is accepted. At this juncture, it is also submitted that the private respondent has already entered appearance in the main case bearing Cr. Appeal (SJ) No. 1355 of 2022. In view of the submissions made hereinabove, there is no need of any further notice.

Accordingly, the modification application stands disposed of to the extent hereinabove.
