The petitioner seeks bail in Chainpur P.S. Case No.112 of 2019 registered for the offence punishable under Sections 302,201,34 of the Indian Penal Code. As per the F.I.R., the prosecution case is that the petitioner and other accused persons have killed the brother of the informant.
Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and he is not named in the F.I.R. Further submission is that the petitioner used to take the land of the deceased on rent but later on he has not been given, as such he had given threatening to kill him. Learned counsel for the petitioner submits that apart from the suspicion, there is no material against the petitioner.

Public Prosecutor has opposed the prayer for bail on the ground that witnesses have supported the prosecution case. In the statement recorded during course of investigation in paragraph-24 of the case diary, witness, Lalan Singh has specifically stated that he had heard sound of firing and seen three accused persons including the petitioner coming with Katta from that direction. Considering the facts, as stated above, I am not inclined to enlarge the petitioner on bail at this stage. Accordingly, the prayer for bail stands rejected. (Vinod Kumar Sinha, J) nawalkrs/- U T
