ANJANA MISHRA ORAL ORDER 14-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 19.08.2019 in connection with Kalyanpur P.S. Case No.195 of 2019 registered for the offence under Sections 272, 273, 34 of the Indian Penal Code and Sections 30(a), 41(1) of the Bihar Prohibition and Excise Act.

It is submitted by the learned counsel for the petitioner that the alleged recoveries were not from the conscious possession of the petitioner but his name has surfaced on the basis of the confessional statement made before the police by Ranjeet Kumar Singh from whom the alleged recoveries of illicit spirit were said to have been made. The

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 9th Additional Sessions Judge cum Special Judge, Excise, Motihari, East Champaran, in connection with Kalyanpur P.S. Case No.195 of 2019.
