JUSTICE ARUN KUMAR ORAL ORDER 20-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Nagarnausa PS Case No. 94 of 2017 (S.Tr. No. 745 of 2017) registered under Sections 302/34 of the IPC and Section 27 of the Arms Act. The allegation in brief is that while the informant's brother along with another person was coming back to the village home then the accused persons, co-villagers, intercepted and it is alleged that Amit Yadav and Santosh Kumar shot at his brother and thereafter escaped away on the motorcycle of Mundrika Yadav.

Learned Counsel for the petitioner submits that the petitioner is co-villager of the informant, there was enmity between both sides, specific allegation of killing is against two other accused Amit Yadav and Santosh Kumar and not against this petitioner, the petitioner has only one criminal antecedent of a case under Section 323 and other sections of the IPC and the investigation is completed. Having considered the said facts and circumstances, the petitioner, namely, Mundrika Yadav @ Mundrika Prasad is directed to be released on bail on furnishing bail bonds of Rs.
