The petitioner seeks regular bail in connection with Gopalpur P.S. Case No. 92 of 2016 registered for the offences under Sections 147, 148, 149, 341, 323 324, 325, 307, 504 and 506 of the Indian Penal Code and Section 25(1-b)a, 26, 35 and 27 of the Arms Act.

The allegation levelled against the petitioner is firing from his pistol on the prosecution side resulting in injury. The learned counsel for the petitioner submits that the petitioner has a clean antecedent, no incident as alleged has ever taken place which is evident from the fact that no gun shot injury has been received by the prosecution side. Having regard to the facts and circumstances of the case, petitioner Sk. Shabuddin @ Md. Shahabuddin is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Bettiah, West Champaran in connection with Gopalpur P.S. Case No. 92 of 2016.
