JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Gopalganj P.S. Case No. 539 of 2018 registered for the offences punishable under Sections 420, 409, 423 and 120B of the Indian Penal Code.
Petitioner happens to be Panchayat Sewak and there is allegation against petitioner and Mukhiya that without getting technical approval of the Scheme they have withdrawn an amount of Rs.22,62,215/- and initiated the work. Submission of learned counsel for the petitioner is that FIR does not show any defalcation by the petitioner, rather it shows irregularity in the Scheme of not taking approval, whereas the petitioner after taking approval has completed the work and the same has been verified by Junior Engineer also
Patna High Court CR. MISC. No.69402 of 2019(2) dt.05-11-2019 2/2 and moreover Mukhiya, who has also been made accused in this case, has been granted anticipatory bail by this Court by order dated 12.6.2019 in Cr. Misc. No. 36057 of 2019. Heard learned APP also.
In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj P.S. Case No. 539 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
