JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 20-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Asarganj P.S. Case No. 25 of 2022, registered for the offences punishable under Section 412 of the Indian Penal Code and 25 (1-b), 26 (I) (II) Arms Act.

As per allegation, the petitioner was arrested with one mobile set, one country-made pistol and four live cartridges. The learned counsel for the petitioner has submitted that the petitioner has been granted bail in the cases mentioned in paragraph no. 3 of the bail petition. The petitioner is under custody since 21.02.2022.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of

Patna High Court CR. MISC. No.69709 of 2022(2) dt.20-03-2023 2/2 the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Munger in connection with Asarganj P.S. Case No. 25 of 2022/, subject to the following conditions:- (i) Further condition is that on commencement of the trial, the petitioner shall appear on each and every date fixed by the Court and if he fails to appear on two consecutive dates, his bail bond shall be cancelled.

(ii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(iii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
