====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-11-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner seeks regular bail in connection with Beldaur P.S. Case No. 112 of 2019 registered under sections 147, 148, 149, 341, 323, 325, 307, 379, 504, 302 of the IPC and 27 Arms Act.

The allegation against the petitioner is that the petitioner along with other accused persons assaulted the informant by means of lathi, danda, iron rod, butt of the pistol etc. causing him injury leading to his subsequent death. Learned counsel appearing for the petitioner submits that both the parties are neighbours and there is land dispute between them inasmuch as proceedings under Section 144 Cr.P.C is pending on the land due to which the present

Learned counsel further submits that no specific allegation is there against the petitioner and the petitioner is lady member of the family of the accused persons. Learned counsel further submits that the petitioner is in custody since 04.06.2019.

After having heard learned counsel for the parties and taking into consideration the fact that both the parties are neighbours and there is land dispute between them and the petitioner is lady member, therefore, I am inclined to grant regular bail to the petitioner.

Accordingly, the petitioner, above named, is directed to be released on bail upon furnishing bail bond of Rs. 20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the Ms. S. Kujur, learned Judicial Magistrate 1st Class, Khagaria in connection with Beldaur P.S. Case No. 112 of 2019.
