2. The petitioner seeks bail in connection with Rajapakar (Baranti O.P.) P.S. Case No. 152 of 2023 registered for the offence under Section 399, 402, 413, 414 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act..

3. As per the prosecution case, the petitioner along with other accused person was preparing to commit a loot.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. He further submits that the petitioner is not caught on the spot and he has been named in the confessional statement of other co-accused namely Shubham Kumar.

5. It is also submitted by the learned counsel for the petitioner that the petitioner has no criminal history and he is in jail since 24.06.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts , this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IX, Vaishali at Hajipur in connection with Rajapakar (Baranti O.P.) P.S. Case No. 152 of 2023.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Bidupur Police Station on first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
