JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2018 Earlier prayer for bail of the petitioner was dismissed vide order 17.04.2017 passed in Cr. Misc. No. 17239 of 2017 and vide order dated 26.07.2017 passed in Cr. Misc. No. 35165 of 2017. In the order dated 26.07.2017, there was direction to the trial court to conclude the trial within a period of six months and petitioner was given liberty to renew his prayer for bail if the trial is not concluded.
Submission of learned counsel for the petitioner is that in this case main accused has already been granted bail and petitioner has been in judicial custody for more than a year and there is no substantive progress in trial.
Earlier a report was called for from the court below, from which it appears that the trial is pending only for the
Patna High Court Cr.Misc. No.9343 of 2018 (3) dt.28-03-2018 2/2 evidence of I.O. and Doctor, as such, I am not inclined to release the petitioner on bail, this application is, accordingly, dismissed. However, the trial court is directed to conclude the trial within a period of three months.
At the same time, District Magistrate and Superintendent of Police, Madhepura is directed to ensure the production of I.O. and the Doctor in the Trial Court on the on the date fixed.
