JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This application, for grant of anticipatory bail, arises out of Matihani P.S. Case No. 181 of 2017, disclosing offences under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per F.I.R. is that petitioner and other two accused persons made firing on the informant causing several injuries to him.
Submission of learned counsel for the petitioner is that only general and omnibus allegation has been levelled against the petitioner and injuries on the person of the informant were found to be of sharp cutting weapon.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that altogether four grievous injuries were found on the person of informant out of
Patna High Court CR. MISC. No.69460 of 2019(2) dt.05-11-2019 2/2 which, two injuries were fire arm injury.
Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner has to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
