ANJANA MISHRA ORAL ORDER 08-03-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 07.10.2017 in connection with Adapur P.S. Case No.192 of 2017 registered for the offence under Sections 341, 323, 324, 307, 376, 511, 504 and 506/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the informant and three other accused persons are agnates and have been on inimical terms since long. The petitioner happens to be a close associate of the agnates and for that reason, the petitioner has also been falsely implicated in this case. Learned counsel for the petitioner further submits that after

Patna High Court Cr.Misc. No.8821 of 2018 (3) dt.08-03-2018 2/2 the alleged occurrence, the informant was placed for medical examination and no external injury was found on her person. The ultrasound, which was conducted on her, also did not reveal any abnormality or any injury. Thus, the petitioner submits that the entire case is false and concocted and has been lodged only to humiliate the agnates and even to the petitioner who has absolutely no connection.

Having heard learned counsel for the petitioner and on consideration of the materials, which have surfaced in the case diary, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, Raxaul at Motihari, East Champaran, in connection with Adapur P.S. Case No.192 of 2017.
