The petitioner is languishing in custody since 14.06.2019 in a case registered for the offences punishable under Sections 153(A), 295(A), 120(B) and 504 of the IPC and Section 66(A) of the Information Technology Act, 2000.

The prosecution case is that on 13.06.2019, some obscene photograph of Goddess Durga was uploaded on the Facebook account of one Rishikesh Kumar. It is alleged against the petitioner that he wrote some objectionable comments on the said photograph.

It is submitted by learned counsel for the petitioner that without any proper verification, the petitioner has falsely been roped in the present case. Moreover, the investigation has

Learned APP the accusation is specific against the petitioner.

Considering the nature of accusation, period under custody, the investigation being already concluded, coupled with the fact that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned CJM, Sheohar in connection with Tariyani P.S.
