2. This application has been filed for grant of regular bail arising out of Singheshwar P.S. Case No. 86 of 2022, registered for the offences under Sections 341, 323 and 302 / 34 of the Indian Penal Code.
3. As per the prosecution case, one Manoj Rishideo has specifically assaulted the deceased with samath (hard blunt substance) and other accused persons have also assaulted the deceased.
4. Learned counsel for the petitioner submits that, the petitioner is innocent and falsely been implicated in this case and he is in custody since 01.04.2023. He further submits that in the post mortem report it has come that the petitioner has died

5. Learned APP has vehemently opposed the prayer of bail.
6. Considering the aforesaid facts, the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S. Case No. 86 of 2022, subject to the condition that the petitioner would co-operate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.
