The petitioner apprehends his arrest in connection with Tarapur P.S. Case No.07 of 2020, registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

The prosecution case, in brief, is that the petitioner was working as agent of Dakshin Bihar Gramin Bank. His work was to collect cash from the customers and deposit the same in the Bank. The informant alleged that the petitioner has collected money to the tune of Rs.21,51,000/- from the customers but he did not deposit the same in the Bank.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no

Patna High Court CR. MISC. No.71614 of 2022(2) dt.02-02-2023 2/2 criminal antecedents as stated in paragraph-3 of the bail application. It is further submitted that there is no specific allegation against the petitioner. No customer has made any complaint against the petitioner.

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner by submitting that the petitioner himself has filed an affidavit to this effect a nd has admitted that he has collected Rs.67,31,325/- from the customer but has deposited only Rs.37,02,391/- and has promised to deposit the rest amount within 15 days in the Bank. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioner is hereby rejected.
