The petitioner apprehends his arrest in a case registered for the offences punishable under Section 406, 420 of the Indian Penal Code.

Allegedly, petitioner is said to have committed fraud with the complainant of Rs. 3,29,000/- It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is service provider. No such occurrence as alleged ever took place. He has been falsely implicated in this case due to ulterior motive. The allegation levelled against the petitioner

Patna High Court CR. MISC. No.72370 of 2022(3) dt.10-04-2023 2/3 is not specific rather general and omnibus in nature. It is further submitted that both petitioner and informant were victim of organised fraud. Both of them opened a site Home Bank Mitre jointly and from there demand for money was started, as detailed in the complaint. He further submits that whatever money came in the account of the petitioner was transferred to the account provided by accused Shubham Manik. He further submits that prior to the instant case, the petitioner filed a complaint case against Shubham Manik being Complaint Case No. 2893 fo 2019. Petitioner has no criminal antecedent as mentioned in para-3 of this application.

Learned APP for the State opposed the prayer for bail and submitted that petitioner is also involved in the alleged fraud.

Considering the facts and circumstances of the case as well as the nature of the offence, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Complaint Case
