JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-04-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 304-B, 201, 120-B/34 of the Indian Penal Code.

Petitioner happens to be husband of the deceased and his prayer for bail was earlier rejected by this court directing the trial court to expedite the trial of the petitioner. The trial court has reported that charge against the petitioner was framed but up till now not a single prosecution witness could be examined.

Considering the aforesaid facts and circumstances as well as submissions of the parties, again I am not inclined to

No.12523 of 2018 (3) dt.11-04-2018 2/2 release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 944 of 2016 arising out of Kateya P.S. Case No. 199 of 2015 pending in the court of learned Additional Sessions Judge-V, Gopalganj stands rejected. However, learned trial court is directed to conclude the trial of the petitioner within six months from the date of receipt/production of copy of this order, failing which the petitioner shall be at liberty to renew his prayer for bail.
