JUSTICE PURNENDU SINGH ORAL ORDER 26-07-2024 Heard Mr. Gajendra Kumar Jha, learned counsel along with Mr. Sushil Kumar Jha, learned counsel appearing on behalf of the petitioner and Mr. Nirmal Kumar Sinha, learned counsel for the State.
2. The petitioner seeks bail in connection with Harinmar P.S. Case No. 18 of 2020 for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
3. Considering the nature of allegation made against the petitioner, as well as, the report submitted by the learned Additional District and Sessions Judge-III, Munger, I am not inclined to enlarge the petitioner on bail. The prayer for bail of the petitioner is, accordingly, rejected.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.70875 of 2023(4) dt.26-07-2024 2/2 petitioner submitted that the petitioner is a very poor person and is below poverty line and his family is not in a position to sustain even daily bread. The question of engaging counsel has further put the family under financial pressure. The petitioner has desired that he would like to seek help of legal aid from the District Legal Aid Authority, Bhagalpur.
5. Considering the aforesaid submission made on behalf of the petitioner, the District Court is directed to request the District Legal Aid Authority to provide legal assistance to the petitioner so that his case may be put before the court in course of time.
6. The bail application stands disposed of.
