The appellant seeks regular bail in Sessions Trial No.159/17 arising out of Ghosi P.S. Case No.321 of 2014 registered for the offence under Sections 147, 149, 341, 323, 325, 379, 354, 504 of the I.P.C., Section 3(1)(X) (XI) of the SC/ST (POA) Act.
Allegation as per the F.I.R. is that when a camp was organized for distribution of the pass book under Indira Awas Yojana for which the husband of the Mukhiya, Ram Pravesh Singh realized Rs.5000/- from each candidate of Mahadalit, the informant made protest upon which the appellants abused her. Thereafter when the brother of the appellant, Shambhu Manjhi resisted them not to abuse the informant, he was assaulted by the appellants with lathi and rod.
Submission of the learned counsel for the appellant is

Having heard both sides and in view of the facts and circumstances, as stated above,the appeal is allowed. Let the appellant, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 1st-cum-Special Judge, Jehanabad, in Sessions Trial No.159/17 arising out of Ghosi P.S. Case No.321 of 2014 subject to the conditions that (1) one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (2) The petitioner will not induce any witness or tamper with the evidence. (3) The petitioner shall co-operate in disposal of trial and make himself available as and when required by the court. In the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled.
