2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 307, 379, 504, 506, 34 and other ancillary sections of the Indian Penal Code.
3. As per the prosecution case, when the informant was at the door of Janki Mahjto, in the meantime, due to previous dispute, all the FIR named accused persons including these petitioners armed with weapons came there and started abusing the informant. On protest, accused persons caught hold the informant and petitioner no.1 inflicted dabia blow on the head of the informant causing him head injury.
4. It is submitted on behalf of the petitioners that the
Patna High Court CR. MISC. No.71918 of 2023(2) dt.07-11-2023 2/2 instant case is counter blast of Matiyariya Police Station Case No. 65 of 2022 lodged by wife of the petitioner no.1 against the informant and his family members. Doctor has found simple injury. There is no allegation of assault against petitioner no.2. Petitioners claim clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Bettiah, West Champaran in Matiariya Police Station Case No. 64/2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
