====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-10-2019 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners apprehend their arrest in connection with Sasaram (Darigaon) P.S. Case No. 526 of 2019 registered under sections 341, 323, 307, 379, 504 and 506/34 of the IPC. The allegation against the petitioners is that the petitioners assaulted the informant, her brother and her mother by means of lathi, danda and also snatched away golden earrings.
Learned counsel appearing for the petitioners submits
Patna High Court CR. MISC. No.62891 of 2019(2) dt.23-10-2019 2/3 that both the parties are agnates and there is land dispute between them as it would be evident from the first information report itself. Learned counsel further submits that there is a case and counter case inasmuch as Sasaram (Darigaon) P.S. Case No. 527 of 2019 has been lodged by the petitioner no.1 for the same occurrence. Learned counsel further submits that injuries caused to the informant, her mother and her brother have been found to be simple in nature except injury no. 1 caused to Dewanti Devi i.e. mother of the informant has been found to be grievous which is on the non-vital part of the body and the same is over the wrist of the right hand.
Having regard to the submissions made by the parties and taking into consideration the fact that both the parties are agnates and there is dispute between them and the injury caused to the victims have been found to be simple in nature except one injury on the non-vital part of the body, I am inclined to grant anticipatory bail to all the petitioners.
Accordingly, the petitioners, above named, in the event of arrest or surrender before the learned Court below within a period of four weeks from today shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like
