2. The petitioner apprehends his arrest in a case registered for offence under Sections 363/366(A) of the Indian Penal Code.
3. There is allegation in the F.I.R. that on 16.06.2017 at about 12.30 PM, the informant's minor daughter went to her house to feed her buffalo, but she did not return and during course of search, one of the villager told that victim was going with this petitioner and later on, dead-body of victim was recovered near Bagmati river.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Informant
Patna High Court CR. MISC. No.70471 of 2024(4) dt.31-01-2025 2/2 is not eye-witness to the occurrence and he has raised only suspicion against this petitioner. As a matter of fact, the informant saw his daughter gossiping with petitioner and coaccused Arvind Sah in the field, then informant scolded his daughter, due to which, she committed suicide by drowning herself in Bagmati river.
5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that there is specific allegation against petitioner that he kidnapped the daughter of informant and this petitioner was last seen with the deceased going towards south.
6. Considering the same, the prayer for anticipatory bail of petitioner is rejected.
