JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-03-2020 The present petition has been filed for restoring a writ petition bearing CWJC no. 11656 of 2019, which has stood dismissed for default on account of non-compliance of the peremptory order dated 18.06.2019.

The learned counsel for the petitioner submits that the requisites etc. have already been filed for the purposes of

Patna High Court MJC No.3907 of 2019(3) dt.04-03-2020 2/2 issuance of notice to respondents no. 3, 8 and 9, hence the order of this Court dated 18.06.2019 has already stood complied with, however there has been a delay of 03 days resulting in dismissal of the writ petition for default.

Having regard to the facts and circumstances of the case and considering the averments made in the present petition as also considering the submissions of the learned counsel for the petitioner, I deem it fit and appropriate to direct for restoration of the aforesaid writ petition bearing CWJC no. 11656 if 2019 to its original file.

The present petition stands allowed.
