2. The petitioner apprehends his arrest in connection with Bahadurpur P.S. Case No.342 of 2022 instituted under Sections 379 and 511 of the I.P.C.
3. As per prosecution case, the F.I.R. named accused persons are alleged to have entered the house of the informant and committed theft. One apprehended accused disclosed the names of other two accused persons, who managed to flee away. The petitioner is alleged to have indulged in selling of stolen articles.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this
Patna High Court CR. MISC. No.73055 of 2024(2) dt.23-10-2024 2/2 case on the basis of disclosure statement of co-accused. Nothing has been recovered from possession of the petitioner. The petitioner was not present at the spot nor he has concern with the other co-accused persons. Petitioner has no criminal antecedent and undertakes to cooperate in the investigation.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Patna City, Patna in connection with Bahadurpur P.S. Case No.342 of 2022, subject to the conditions as laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
