====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 13-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Hussainganj P.S.Case No. 234 of 2024 dated 24.06.2024 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 326 and 504 of the I.P.C.

3. As per the prosecution case, the petitioner assaulted the informant in his stomach using Fasuli, while he was coming after closing his Flour Mill.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the allegation against the petitioner is that he assaulted the informant in his stomach using a Fasuli.

No.66934 of 2025(2) dt.13-10-2025 2/3 It is further submitted that the injury report purportedly obtained in the present case appears to be a collusive document and it is entirely unclear how the said injury was reported to be grievous in nature. The name of the petitioner has surfaced in the present case after much consultation and afterthought. It is further submitted that the scuffle took place between the co-accused Krishna Sahani and the informant on account of wrong parking of the motorcycle allegedly obstructing road traffic. The petitioner was not present at the place of occurrence on the alleged date and time of occurrence.

It is further submitted that the occurrence took pace on the spur of the moment while both the parties had assembled and there is no premeditation or intention to cause injury to the informant and others. It is further submitted that the other co-accused persons Makurdhan Sahani @ Mukurdhan Sahani @ Makurudhan Sahani @ Makurdhan Sahni in Cr. Misc. No. 25493 of 2025 vide order dated 09.05.2025 and Pannalal Sahani @ Pannalal Sahni in Cr. Misc. No. 70427 of 2024 vide order dated 03.10.2024 have been granted bail by the Co-ordinate Bench of this Court, annexed as Annexure P/2 to the present bail petition. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 17.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-I, Siwan in connection with Hussainganj P.S. Case No. 234 of 2024.

7. The application stands allowed.
