Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 3.4.2017 passed in Cr. Misc. No.8417 of 2017 with a direction to the learned trial court to expedite the trial and try to conclude the same within a period of nine months from the date of order Submission of the learned counsel for the petitioner is that at present even the commitment of the case has not been made, the petitioner is in custody since 2.9.2016 and he is accused in one case also.

Heard learned A.P.P. also.

Having heard both sides and perused the report, from which it appears that the case is pending for commitment, in such

No.2988 of 2018 (3) dt.08-02-2018 2/2 view of the matter, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Patna in connection with Agamkuan P.S.case no.230 of 2016 dated 9.7.2016, with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
