Petitioner seeks bail in a case registered for the offences punishable under Sections 399/402/414 of the Indian Penal Code and Sections 25 (1-b), a, 26, 35 of the Arms Act.
A country made loaded pistol was recovered from possession of the petitioner alongwith a motorcycle. Allegation is that the petitioner and others were preparing to commit dacoity.
Submission is that the petitioner has got no criminal antecedent.
Petitioner is in custody since 05.12.2017. Investigation is already complete. Petitioner is ready to cooperate with the trial.
Patna High Court Cr.Misc. No.6977 of 2018 (3) dt.20-03-2018 Considering the entire facts aforesaid, let the petitioner, above named, be released on bail after completion of nine months of custody on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Pachrukhi Police Station Case No.282 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
