ANJANA MISHRA ORAL ORDER 20-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 29.09.2016 in connection with POCSO Case No.46 of 2016 arising out of Chandi P.S. Case No.88 of 2016 registered for the offence under Sections 363 and 366A/34 of the Indian Penal Code. Diary in the present case was called for, which has since been received.

It appears that the petitioner is in jail for almost one year and five months and the entire case is based on love affair though, admittedly, the girl was minor at the time of the occurrence.

Considering the entire facts and circumstances and
