ANJANA MISHRA ORAL ORDER 31-01-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. At the outset, learned counsel for the petitioners prays to withdraw the application as against petitioner No.1, Shyam Nandan Yadav @ Shyam Yadav, as he has already been taken into custody.

The application as regards petitioner No.1 stands dismissed as withdrawn.

So far as Petitioner No.2, namely, Devnandan Yadav, is concerned, this second application for anticipatory bail has been filed in view of the changed circumstances that other similarly situated person has since been extended the privilege

Patna High Court Cr.Misc. No.4614 of 2018 (2) dt.31-01-2018 2/2 of anticipatory bail in Cr.Misc. No.46717 of 2017, vide order dated 15.11.2017.

Considering the nature of allegations made against the petitioner and that his case stands on similar footing, let Petitioner No.2, Devnandan Yadav, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, District-Gaya, in connection with Sherghati P.S. Case No.38 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
