Petitioners, already in custody, seek bail in connection with Rafiganj P.S. Case No.200 of 2017, registered under Sections 30(a)/38(I), 38(ii) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners contends that the recovery is from the place accessible to anyone by the side of the boring of the petitioners kept in concealed condition, petitioner nos.2 and 3 have no criminal antecedent and the petitioners are in custody since 07.12.2017.
Having considered the said facts and circumstances, petitioners, namely, Shrinath Yadav @ Kaila @ Santosh Yadav,
Patna High Court Cr.Misc. No.3700 of 2018(2) dt.31-01-2018 2/2 Yogendra Yadav @ Sobha Yadav and Ashok Yadav @ Chhotu Yadav are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum-Special Judge (Excise), Aurangabad in connection with Rafiganj P.S. Case No.200 of 2017. However, petitioner no.1 having criminal antecedent of similar nature is found indulged in subsequent case of similar nature, his bail bond shall liable to be cancelled in accordance with law.
