2. The petitioner seeks bail in connection with Madhaura P.S. Case No. 280 of 2023 registered for the offence punishable under Sections 370, 371 and 372(1)/34 of the Indian Penal Code; Section 8 of POCSO Act; Section 75/79 of the Juvenile Justice Act; Sections 3, 4, 5 and 6 of the I.T.P. Act, 1956 and Sections 16, 17 and 18 of the Bonded Labour System (Abolition) Act, 1976.

3. As per the prosecution case, the petitioner had employed girls in an orchestra.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 20.08.2023. Learned counsel

Patna High Court CR. MISC. No.71307 of 2023(2) dt.07-11-2023 2/2 further submits that a co-ordinate Bench of this Court vide order dated 18.10.2023 in Cr. Misc. No. 68020 of 2023 has granted bail to a similarly situated co-accused namely, Aash Mohammad.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. For the reasons mentioned in Cr. Misc. No. 68020 of 2023 vide order dated 18.10.2023, the same is also allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Judge, POCSO Act, Saran, Chapra in connection with Madhaura P.S. Case No. 280 of 2023.

8. While furnishing the bail bonds, the petitioner shall also give an undertaking in the Court below that he will not employ minor girls in his orchestra.
