2. The petitioner seeks bail in connection with Khagaria P.S. Case No. 738 of 2023 registered for the offence under Sections 364(A) of the Indian Penal Code.

3. As per the prosecution case, this petitioner along with other co-accused kidnapped the victim for ransom.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He is in custody since 23.07.2023. It is further submitted that the petitioner is not involved in the kidnapping as per the statement of the victim recorded under Section 164 of the Cr.P.C.

5. Learned A.P.P. has vehemently opposed the prayer for bail and has submitted that the prosecution case has been supported by the victim in her statement made under Section 164 of the Cr.P.C.

6. Considering the rival submission of the parties and the allegation levelled against the petitioner, I am not inclined to grant bail to the petitioner.

7. This application stands rejected with liberty to the petitioner to renew his prayer for bail after examination of the victim in the trial.
