Petitioner, already in custody, seeks bail in connection with Ariyari (Kasar) P.S. Case No.130 of 2017, registered under Section 392 of the Indian Penal Code.
Allegation in brief is that while the informant after withdrawing Rs.2,20,000/- from ATM was coming back then on the way at lonely place some motorcycle borne miscreants relieved him of that money.
Learned counsel for the petitioner submits that the petitioner is implicated in this case on the basis of disclosure of his name in the confessional statement of co-accused Subhash Kumar and Gaurav Kumar, except that there is no other material, neither any recovery was made from possession of the
Patna High Court Cr.Misc. No.9196 of 2018(2) dt.16-02-2018 2/2 petitioner nor he was put on TIP and charge-sheet has been submitted in this case.
Having considered the said facts and circumstances, petitioner Deepak Kumar @ Dara is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sheikhpura in connection with Ariyari (Kasar) P.S. Case No.130 of 2017 with condition that the petitioner shall remain present on each and every date before the trial court as and when required and if he absents himself on two consecutive dates without reasonable ground, his bail bond shall liable to be cancelled.
