1. Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 354B, 379, 506 and 504 of the Indian Penal Code.

3. As per the prosecution case, when the minor niece of the informant was returning home, this petitioner is alleged to have caught her hand with bad intention and tried to outrage her modesty.

4. It is submitted on behalf of the petitioner that both parties are co-villagers and next door neighbors and due to petty dispute, a simple marpit took place in which both sides sustained injuries. Case and counter case. Taking into advantage of the situation, this false case with concocted allegation has been levelled against this petitioner. Petitioner has got

5. Learned APP for the State vehemently opposed the prayer of bail.

6. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Sheikhpura/concerned court below in connection with Ariyari P. S. Case No. 259 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
