2. Petitioner apprehends his arrest in connection with Nabinagar (Badem) P.S. Case No. 422 of 2022, registered for the offence punishable u/s 379 of the IPC, pending in the court of Additional Chief Judicial Magistrate-I, Aurangabad.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if petitioner surrenders before the learned Court below within six weeks from today and seeks regular bail,
