The petitioner seeks bail in a case registered for offences under Sections 30 (A) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, huge quantity of foreign liquor was recovered from the ditch and on the basis of confession of co-accused the petitioner has been implicated in this case. So far as antecedent is concerned, it is stated that for the purpose of illicit liquor this FIR was drawn whereas for the purpose of recovery of two live cartridges from the
Patna High Court Cr.Misc. No.53339 of 2017(2) dt.09-11-2017 2/2 possession of the petitioner, Begusarai Muffasil P.S. Case No. 265 of 2017 has been registered under Sections 25(1-B)A, 26 and 35 of the Arms Act. It is urged that the petitioner is in custody since 19.06.2017.
Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-VIIcum-Special Judge, Excise, Begusarai in connection with Muffassil P.S. Case No. 266 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
