2. The petitioner is in custody since 03.08.2023 in connection with Bodh Gaya (Cherki) P.S. Case No. 646 of 2023 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 60 litres of illicit liquor has been recovered.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing incriminating has been recovered from the possession of the petitioner. He next submits that the petitioner is a student and no way connected with the alleged recovery of

Patna High Court CR. MISC. No.72711 of 2023(2) dt.09-11-2023 2/2 liquor. The petitioner has no criminal antecedents.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, Gaya in connection with Bodh Gaya (Cherki) P.S. Case No. 646 of 2023.

7. The petitioner is directed to mark his attendance in Cherki police station on 1st Sunday of every month.

8. It is made clear that any default in appearance in the aforesaid police station, as directed, would result in cancellation of bail bond of the petitioner.
