1. Heard learned counsel for the parties.
2. The petitioner has filed the instant application for grant of regular bail in connection with Barachatti P.S. Case no. 260 of 2023 registered under sections 8(b), 18 and 29 of the N.D.P.S. Act.
3. As per the prosecution case, on information having been received a raid was conducted and opium was found planted in 13.5 acres of land. It is further stated that on enquiry it was disclosed that it was the petitioner who had planted the opium plant.
4. It is submitted by learned counsel for the petitioner that the allegation as levelled in the F.I.R. are false and concocted. He has neither any concern with the recovered opium plantation nor with the land on which the same was planted. The petitioner has no criminal antecedent and is in
Patna High Court CR. MISC. No.68746 of 2023(2) dt.01-11-2023 2/2 custody since 12.7.2023. Charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the FIR, the submissions made by learned counsel for the petitioner, petitioner having remained in custody since 12.7.2023 and charge-sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Barachatti P.S. Case no. 260 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-Cum-Special Judge N.D.P.S.
