Learned counsel for the petitioners submit that the present anticipatory bail application has been filed for Petitioner Nos. 2 and 4.
The petitioners are apprehending their arrest in connection with Sidhwalia P.S. Case No. 123 of 2019 for the offence registered under Sections 341, 323, 325, 307, 379/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that so far as the allegation against Petitioner No. 2 is concerned, he is alleged to have assaulted the informant but the injuries have
Patna High Court CR. MISC. No.61397 of 2019(3) dt.03-12-2019 2/2 been found to be simple in nature and so far as the Petitioner No. 4 is concerned, no specific role has been attributed to him and, therefore, they may be extended the privilege of anticipatory bail.
Learned counsel for the State, on the perusal of the Case Diary, submits that except the allegation against the Petitioner No. 2 which has been found to be simple, no other allegation is against Petitioner No. 4.
In view of the aforementioned facts and circumstances, and the fact that the petitioners have no criminal antecedent, let the petitioners No. 2 and 4, namely, Sikandar Sah and Buchi Singh, in the event of their arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate VI, Gopalganj, in connection with Sidhwalia P.S. Case No. 123 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
