The petitioner is in custody since 18.07.2019 in connection with Muffasil P.S. Case No. 319 of 2019 for the offence registered under Sections 401, 413, 414, 379 and 411/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was taken into custody only on suspicion and he was unaware as to the fact that the motorcycle, in question, was stolen one. It is further submitted that the main offender succeeded in skipping whereas the petitioner has been taken into custody. It is further submitted that the recovery was not made from his possession and he may be extended the privilege of

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Muffasil P.S. Case No. 319 of 2019.
