JUSTICE VIKASH JAIN ORAL JUDGMENT Date : 05-12-2018 The present writ petition has been filed for setting aside the advertisement of quotation no. 05/13-14, Group No. 1, 2 and which was opened in favour of one Vijay Electrials; and for connected reliefs.

2. As none appeared on behalf of the petitioner the matter was passed over for a few cases. However, on repeat call the petitioner was again not represented.

3. Learned counsel for the respondents invites reference to para 6 and 7 of the counter affidavit to submit that Vijay Electricals in whose favour the tender was awarded has not been impleaded as respondent. It is further

Patna High Court CWJC No.22834 of 2013 dt.05-12-2018 2/2 stated that the said work related to the financial year 201314 could not be executed by the end of the said financial year and could not be proceeded as the same was under non-plan head and was surrendered in the year ended on 31.03.2014. Accordingly, a fresh tender for the same work was invited vide NIT No. 1/2014-15.

4. Having regard to the stand of the respondents, the writ petition is found to be not maintainable and dismissed as such.
