JUSTICE ARUN KUMAR ORAL ORDER 04-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 19.10.2017, seeks bail in Ara Nawada PS Case No. 473 of 2017 registered under Sections 324, 326, 307 of the IPC and Section 27 of the Arms Act.. The allegation in brief is that while the informant along with his friend were sitting at the staircase of his market then three motorcycle borne criminals came there and two pillion riders shot at the informant and his friend causing fire arm injury to both of them, the petitioner was driving the motorcycle and thereafter all the three escaped away.

Learned Counsel for the petitioner submits that there is no specific allegation of firing against the petitioner, he is in custody since 19.10.2017.

Whereas learned Counsel for the State submits that all the three accused came and two shot at the informant and his friend causing fire arm injury to them and this occurrence was committed in the market place.

Having considered the said facts and circumstances, presently the prayer for bail of the petitioner is rejected, Snkumar/- (Arun Kumar, J) U T
