JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 504, 387, 506, 34 of the Indian Penal Code.

The first information report reflects that first occurrence took place on 09.01.2019 and thereafter, second occurrence took place on 20.01.2019 but the present case was lodged on 22.01.2019 without any explanation of delay. Moreover, petitioner does have criminal antecedent of some cases which have been lodged under the provisions of Bihar Excise Act as well as Arms Act.

Considering the aforesaid facts and circumstances as

No.62834 of 2019(2) dt.04-12-2019 2/2 well as submissions of the parties and also keeping in mind that petitioner is in jail custody since 06.07.2019, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P.S. Case No. 11 of 2019.
